¿Y si vamos a arbitraje? El arreglo interino multipartes de arbitraje: análisis y vacíos legales

Resumen

En diciembre del año 2019 expiró el periodo de trabajo de dos miembros del Órgano de Apelación, el que, de esta forma, se convirtió en una institución inoperativa. En este contexto, un conjunto de Miembros de la OMC decidió negociar un mecanismo alternativo para resolver sus diferencias de manera definitiva: «El Arreglo Interino Multipartes de Arbitraje». Este artículo tiene por finalidad analizar el funcionamiento de este instrumento, evidenciar algunos asuntos no resueltos y explicar que la reforma del sistema de solución de diferencias de la OMC es parte de un problema mayor vinculado a la necesidad de reformar esta misma organización internacional.

Abogado por la Pontificia Universidad Católica del Perú, magíster en Estudios Avanzados en Derecho Internacional y Economía por el World Trade Institute (Suiza). Analista legal en el Ministerio de Comercio Exterior y Turismo del Perú (Mincetur) y profesor en la Universidad Privada de Ciencias Aplicadas (UPC), en la Pontificia Universidad Católica del Perú (PUCP) y en la Universidad Científica del Sur (UCS).
