Abstract

The spread of artificial intelligence (AI) in labor management introduces new challenges for corporate law. Automating tasks such as recruitment and performance evaluation enhances efficiency but creates risks of bias, surveillance, and opacity. This article, adopting a dogmatic-analytical and comparative approach, examines algorithmic labor management through the lens of the European AI Act, the Platform Work Directive, ISO 42001, and Peruvian data protection legislation. It proposes the concept of digital corporate responsibility, understood as the extension of the company’s duty of care to the technological domain, and introduces algorithmic auditing as a compliance tool intended to ensure transparency and meaningful human oversight. Accordingly, modern corporations must integrate algorithmic governance into their policies to balance innovation with the protection of fundamental rights.
